1. Introduction
Welcome to Magni Development (“we”, “the Agency”, “the Platform”), accessible through the website magni.dev.
These Terms of Service govern access to and use of:
- Our website, including the blog and documentation for developers and customers.
- Our custom software development services (“Agency Services”).
- Our proprietary software applications and digital products (“Apps”).
By accessing magni.dev or using any of our services, you (“the User” or “the Customer”) agree to be legally bound by these terms. If you do not agree with any part of these terms, you must not use our services.
2. Unified Account (Magni Account)
To access the full functionality of our Apps and certain development resources, you must register an account.
- Single Credentials: Magni Development uses a single sign-on (SSO) system. The account created on
magni.dev will serve as your universal access key for all proprietary Magni Development Apps you purchase or subscribe to.
- Security: You are solely responsible for maintaining the confidentiality of your login credentials. You accept responsibility for all activities that occur under your account in any of our Apps.
- Notification: You must notify us immediately of any unauthorized use of your account or any other security breach.
- Suspension: We reserve the right to suspend or delete your account (revoking access to all linked Apps) if we detect fraudulent behavior, system abuse, or violations of these terms.
3. Agency Services (Custom Development)
When you hire Magni Development to build specific software:
- Scope: Project details, timelines, and deliverables will be defined in a separate commercial proposal or services agreement.
- Code Ownership: Unless otherwise agreed in writing, the intellectual property and exploitation rights of the custom software will be transferred to the Customer once the full agreed payment has been settled. Magni Development reserves the right to reuse generic or open-source code libraries used in development, provided they do not infringe on the Customer’s unique business logic or trade secrets.
4. Use of Proprietary Apps (Licensing)
By purchasing or subscribing to one of our Apps (products developed and sold by Magni Development):
- License Grant: You are granted a limited, non-exclusive, non-transferable, revocable license to use the App in accordance with its intended purpose.
- Restrictions: You do not acquire ownership of the software. You are prohibited from:
- Reverse engineering, decompiling, or attempting to extract the source code of our Apps.
- Reselling, sublicensing, or redistributing our Apps without express authorization.
- Using our Apps for illegal or unauthorized activities.
5. Intellectual Property of the Site and Resources
All content available on magni.dev, including but not limited to logos, visual design, blog articles, tutorials, and documentation for developers, is the exclusive property of Magni Development or its licensors and is protected by intellectual property laws.
- Documentation Use: You may use code snippets provided in our documentation and blog for learning or integration purposes, with the understanding that they are provided “as is”.
6. Payments and Refunds
- Pricing: Prices for our Apps and services are listed on the website or in commercial proposals and may be subject to local taxes.
- Subscriptions: If the service is subscription-based, it will renew automatically at the end of each period unless the user cancels before the renewal date.
- Refund Policy: Due to the digital nature of our products, we do not offer refunds once access to the software has been provided, except in exceptional cases at our discretion.
7. Limitation of Liability
Magni Development provides the website, Apps, and documentation “as is” and “as available”.
- Disclaimer of Warranties: We do not guarantee that our Apps will be error-free or that access will be uninterrupted.
- Damages: In no event will Magni Development be liable for indirect, incidental, special, or consequential damages (including data loss, business interruption, or lost profits) arising from the use or inability to use our services or the unified account system.
8. Changes to the Service and Terms
We may update these terms from time to time to reflect changes in our practices or for legal reasons. We will notify you of material changes via the email associated with your Magni Account or through a prominent notice on our site.
9. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of Mexico. Any dispute related to these terms will be submitted to the exclusive jurisdiction of the courts of Mexico City, Mexico.
